These Terms of Service (“Terms”) govern your use of the website and services provided by Kiana Dunn Photography (“we,” “us,” or “our”). By accessing this website or placing an order for any product, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the site.
2. Intellectual Property
All content, including but not limited to photographs, text, designs, and website layout, is the sole property of Kiana Dunn and is protected under United States and international copyright laws.
You may NOT:
Download, reproduce, or distribute any images or content without written permission.
Use any image for commercial, editorial, or personal use, including social media or AI training, without express licensing.
Claim any artwork or content from this website as your own.
Purchase of a physical print does not include any right to reproduce, license, scan, or otherwise use the image beyond personal display.
3. Product Description and Customization
All fine art prints offered through this website are custom-made at the time of order. Customers may select sizing and framing options as offered. Each print is produced individually and tailored to the specifications chosen at checkout.
Due to the nature of custom photographic printing and digital screen variations, slight differences in color or crop may occur. These differences do not constitute defects.
4. Order Processing and Shipping
All prints are produced on demand and are typically processed within 7 to 14 business days after order confirmation. Shipping time may vary based on location and carrier.
We offer domestic shipping within the United States and international shipping to select countries.
International customers are responsible for any import duties, customs fees, VAT, or GST applicable in their jurisdiction. We are not responsible for any delivery delays caused by customs processing.
5. Returns and Refund Policy
Due to the custom-made nature of our products, all sales are final.
Returns, exchanges, and cancellations are not accepted except in the case of damage or defect. If you receive a damaged or defective product, you must notify us within 7 calendar days of delivery and provide photographs of the issue.
We will offer a replacement of the damaged product at no additional cost, or issue a refund at our discretion.
Requests made beyond 7 days after delivery may not be honored.
6. International Consumer Rights
Residents of the European Union, United Kingdom, Australia, and New Zealand may have additional consumer rights under local legislation. However, under EU Directive 2011/83/EU, the UK Consumer Contracts Regulations 2013, and corresponding regulations in Australia and New Zealand, the right to withdraw from a purchase within 14 days does not apply to custom-made goods.
By placing an order on this website, you acknowledge and agree that you are purchasing a product that is made to order, and that your right to cancel the purchase under consumer protection laws may be limited.
7. Limitation of Liability
To the fullest extent permitted by law, Kiana Dunn Photography shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of this website or the purchase of any products.
We make no guarantees regarding the continuous availability of the site, uninterrupted service, or error-free functionality.
